| Council Consideration of a Bid Award for the 2012 Water and Sanitary Sewer Main Replacement Project to North Star Energy and Construction, LLC, in the Amount of $2,732,944.32. |
| BACKGROUND: |
This project consists of replacing water and sanitary sewer mains in the following areas:
1. Water Main in Apricot Street from 2nd Avenue to 5th Avenue.
2. Water Main in Beech Street from 2nd Avenue to 5th Avenue.
3. Water Main in 3rd Avenue from Beech Street to Apricot Street.
4. Sewer Main in Apricot Street from 2nd Avenue to 4th Avenue.
5. Sewer Main in Beech Street from 2nd Avenue to 4th Avenue.
6. Sewer Main in Elm Street from 4th Avenue to 5th Avenue.
7. Sewer Main west of Fir Avenue from 1st Street to 2nd Street.
8. Sewer Main in Larch Street from Pacific Steel to Burma Avenue.
9. Sewer Main in Warlow Drive from the Animal Control Shelter to Burma Avenue.
10. Sewer Main in Bay Avenue from 1st Street to Echeta Road. |
| ACTUAL COST VS. BUDGET: |
Bids were opened on Wednesday, March 20, 2013 at 2:30 p.m. at the office of the City Purchasing Division, Central Warehouse, 800 N. Burma Avenue, Gillette, Wyoming. The results of the bid opening are as follows:

BID IRREGULARITIES:
During the bid evaluation, discrepancies with the bid requirements outlined in the Instruction to Bidders were discovered. The informalities include:
North Star Energy and Construction, LLC did not provide evidence of authority to sign for the limited liability (Article 13.05 of ITB). DRM, Inc. did not provide evidence of authority to sign for the corporation (Article 13.05 of ITB). As per Article 19.03, omission of authority is considered a bid informality but is not to be considered as grounds for rejection.
Intermountain Construction and Materials, Inc. did not date every page of the electronic bid form printout (Article 15.03 of ITB). However, they did sign every page of the printout. As per Article 19, omission of dates when signed is considered a bid informality but is not to be considered as grounds for rejection.
All of the informalities found are reason to classify the Bids "informal", but are not grounds for rejection as per the guidelines in Article 19.03 of the Instruction to Bidders.
CONSTRUCTION ESTIMATE:
The total construction cost for this project was estimated at $2,958,720.00 and was prepared by HDR Engineering, Inc. The low bid was $2,732,944.32, approximately 8.3% lower than the Engineer's Estimate.
BUDGET:
Monies for this project has been budgeted from 1% Optional Sales Tax Fund #201-1011-419-7410 and #201-1011-419-7420 in the amount of $2,000,000.00 and $1,700,000.00 respectively.
CONTRACTOR'S REVIEW:
North Star Energy and Construction, LLC has no apparent problem with their bid.
