SUBJECT:
An Ordinance to Amend Section 16-3 of the Gillette City Code Concerning Enforcement of Section 17-21 GCC by Special Municipal Officers.
BACKGROUND:
Amendments are proposed to Section 16-3 of the Gillette City Code which lists specific municipal employees by position title who can issue municipal citations for violations of specified city ordinances. State Statutes were amended in 2007 to authorize Special Municipal Officers to issue citations for violations of municipal ordinances. The Special Municipal Officers are not authorized to arrest or to carry firearms. Section 16-3 was written to cover parking violations, animal control, building and zoning cases and nuisances. This particular ordinance has been drafted to authorize specific employees to issue citations for the recently amended Section 17-21 of the Gillette City Code that covers outside watering on Mondays and other forms of  water wasting. 

               This amendment would authorize the Sustainability Coordinator, the Community Services Officers and the Code Compliance Inspectors to issue citations for this section. In addition this amendment updates the list of Position Titles to bring it up to date with the position titles that have changed since the ordinance was originally enacted in 2007. The Building Division Supervisor is now the Chief Building Official and the Community Development Director is now the Planning Manager. We would also recommend adding the Engineering and Development Services Director to enforce the Zoning Ordinance and the Deputy Building Official to enforce the Building codes in Chapter 5.The new language is highlighted in yellow and the replaced language is shown with strikethroughs.
