SUBJECT:
Council Consideration for the Approval of the Agreement for Joint and Co-Operative Action Third Amendment to the Campbell County Public Land Board Agreement.
BACKGROUND:
     The County has approved this draft of an amendment to the Camplex Joint Powers Agreement. It contains new material as well as language that is intended to be housekeeping. In addition, the County approved a map for the Camplex annexation that includes the original 740 acres of the original Experimental Farm and an additional 20 acres that includes the model airplane area, which receives both City electricity and water at this time. This draft is a good resolution of many issues and will make a good foundation for working with the County in the future. 

                                             Financing and Budget

     Article VII has been modified to specify that the City and County split capital budget items 50:50, which has been the practice for many years. The new language also provides that the City shall pay a set portion of the operating expenses of Camplex, from 15% in fiscal 2013/2014 to 20% in fiscal 18/19 in 1% annual increments. 
    
In case the 1% sales tax is defeated or if Sales tax revenue decreases by over 20% in any one year there is also language that provides for discussion between the parties concerning the Budget and distribution of funding. As additional protection against changes in Sales Tax revenues, the amendment to Article VI provides that Article VII Financing would be up for discussion every two years, as it is in the Fire JPA.

                                             Powers of the Board 

     Article IV contains new language in three new subsections, (K) (L) and (M). (K) borrows language from the Fire JPA to say that the Land board will operate with County compensation, benefits and personnel policies. (L) is a consent to annexation of the original 740 acres and states that after annexation both the Police and Sheriff will have law enforcement duties, the Police being primary for day to day operations. We anticipate the details will be specified in an MOU with the Sheriff. (M) deals with water and effluent. It states that Camplex will receive water at the Wholesale rate when such a rate is approved. That section also says that the parties will make an agreement about treated effluent for Camplex when it is available. Substantial treatment facilities will have to be financed to make treated effluent available, which will likely be a topic of any future agreement on this subject. 

                                             Duration and Termination          

     The language in Article VI is borrowed from the Fire JPA. It mandates a review every 2 years of the Financing formula and provides a methodology for terminating the agreement and dividing the assets that was not covered very well in the existing agreement.
