| Council Consideration for the Acceptance of Public Improvements for the PMS 2013 Schedule A Project, Installed by Simon Contractors, in the Amount of $1,157,057.17. |
| BACKGROUND: |
|
The PMS 2013 Schedule A Project included miscellaneous concrete repairs, pavement repairs and overlay, fire hydrant replacements, installation of additional water valves, storm sewer repairs, and sanitary sewer repairs on Clarion Drive from Overdale Drive to Fairway Drive and on Trail Street from Overdale Drive to Clarion Drive. The total surface length is approximately 4,035 LF of Clarion Drive and 705 LF on Trail Street.
The Notice to Proceed was issued on May 6, 2013 and the Certificate of Final Completion was issued on September 23, 2013 which was within the contract time allotted.
The Affidavit on Behalf of the Contractor, Certificate of Final Completion, and Warranty are attached for reference.

| ACTUAL COST VS. BUDGET: |

The original contract with Simon Contractors was in the amount of $1,116,094.20. There were seven (7) change orders executed resulting in a net increase of $40,962.97 resulting in a final contract of $1,157,057.17.
Additional water valves, a fire hydrant adjustment, and remedies to address the super saturated subgrade and coal seams accounted for the increase to the contract.
Funding for this project was allocated from the 1% Optional Tax Account 201-10-05-419-40-44331.
