| Council Consideration of an Agreement to Amend EBS Long Term De Facto Transfer Lease Agreement. |
| BACKGROUND: |
| City Electrical Division staff and representatives of the Campbell County School District have discussed changing the school buildings that will receive fiber optic cable connections from the City. The City agreed to connect numerous school facilities and lease them fiber optic lines in exchange for the use of a license to operate Educational Broadband Service that is held by BOCHES for the City's mobile technology project. The City agreed to install fiber optic cables to connect the Campbell County School District (“CCSD”) facilities described in Exhibit B, entitled WiMax Construction Plan, to the fiber optic network using certain public and private rights-of-way owned by the City (“Fiber Network”). Exhibit B provides that in Year 4 fiber optic connections are to be provided to Lakeview Elementary School and the Aquatic Center. The CCSD and BOCHES and City have agreed to install fiber optic connections to the Buffalo Ridge Elementary School and the CCSD Maintenance Building in lieu of to Lakeview Elementary School and the Aquatic Center respectively. |
