SUBJECT:
Council Consideration for the Acceptance of Public Improvements for the McManamen Park Pathway Project, Installed by Powder River Construction, Inc., in the Amount of $782,649.12.
BACKGROUND:
The project consisted of  a 10' wide pathway around the perimeter of McManamen Lake with connections to the pathway along Warlow Drive.  The length of the pathway is 7,400 lineal feet. An observation area was constructed adjacent to the pathway on the berm located on the westerly side of the lake.

Also included in this project was a large concrete box culvert installed in the Burlington Ditch, just west of the lake.  This allowed the pathway to be constructed over the ditch, accommodating a future project which will widen and increase the capacity of the Burlington Ditch. The improvements to the ditch were identified in the Storm Water Master Plan.

The contract established 55 working days to Substantial Completion and 65 working days for Final Completion. The Notice to Proceed was issued on October 8, 2012 and the project was placed in Winter Shut-Down on  November 9, 2012 due to adverse weather. The revised Notice to Proceed was issued on May 1, 2013.  With the adverse weather days the project was to be finished on July 30, 2013. This date was not met and Powder River Construction, Inc. was assessed liquidated damages for Substantial Completion in the amount of $2,000.00 and liquidated damages for final completion in the amount of $2,000.00.
ACTUAL COST VS. BUDGET:
The original contract with Powder River Construction, Inc. was in amount of  $649,521.50. There were five (5) change orders for a net increase of $133,127.62 resulting in a final contract of $782,649.12.

Additional work was necessary for the subgrade preparation to support the pathway along the lake which accounted for the increase to the contract.

Funding for this project was allocated from 1% Optional Sales Tax Accounts:
