When the School District reviewed the MOU that was approved by the Council on 11/5/2013 with the School Facilities Commission, some concerns were raised. The Commission was concerned about the provision that would obligate the CCSD to transfer the Lakeview school to the Boys and Girls Club if the grant from the Wyoming Business Council was not approved. The Commission was advised by a member of the Attorney General's office that the CCSD could transfer the property to the City but not to a private group. The City was asked whether it would be interested in taking title to the property whether or not the grant was approved. The City Council discussed this matter at the work session on December 10, 2013 and directed staff to prepare the necessary changes to the MOU. In the event that the grant is not approved, the City will have the option to transfer the property directly to the Boys and Girls Club according to the process contained within Wyoming Statute section 15-1-112 (b)(i)(D), which permits the City to sell any property to "[a]ny person acquiring the property for a use which the governing body determines will benefit the economic development of the municipality". The language in the attached MOU that appears in yellow is language deleted from the draft approved on 11/5/2013 and the language that is in red is new language.
