SUBJECT:
Council Consideration of a Performance and Completion Agreement for Acceptance of Remaining Construction Items for the Gillette Madison Pipeline Project with Raymond F. Elsner and Susan E. Elsner in the Amount of $2,000. 00.
BACKGROUND:
The City secured a permanent waterline easement with Mr. and Mrs. Elsner in 2011 for construction and installation of the new Madison Pipeline and the separate Liebherr Phase II 12-inch Waterline across private property located between Schoonover and Swanson within Block 2, Lots 5, 6 and 12 of the Mohan Subdivision.

Garney Wyoming Inc. was awarded the construction contract in 2012 and is in the final stages of completing the construction for Contract 4a of the Gillette Madison Pipeline Project which includes the new 42-inch Transmission Pipeline and separate 12-inch Distribution Pipeline that crosses the Elsner Property.

As a condition of our permanent waterline easement with the Elsner's, the City agreed to certain construction performance requirements for final seeding, reclamation, fencing and pipeline installation.

The attached "Performance and Completion Agreement memorializes and provides additional detail for the completion of the remaining construction-related items that will be acceptable to the Elsner's.  City Staff recommends approval of this agreement.
ACTUAL COST VS. BUDGET:
Most of the costs associated with the completion of the remaining items within this agreement will be covered under our existing construction contract with Garney Wyoming Inc.  Costs not covered by the Garney Construction Agreement will be expensed from the Madison Fund.
