Council Consideration of a Permit Request from the Campbell County Cemetery District to Re-Drill Water Well No. 4 on Cemetery Property in Accordance with Chapter 12 of the City Code. 
BACKGROUND:
The Campbell County Cemetery District has requested the City of Gillette permit drilling operations within the City Limits, in accordance with Chapter 12 of the Gillette City Code, to re-drill the Cemetery District's Water Well No. 4 located upon property owned by the Campbell County Cemetery District.

The existing Cemetery Water Well No. 4 is in need of replacement due to a bad well seal, poor water quality, and casing failure. The proposed re-drill is approximately thirty (30') feet southeast of the existing Well No. 4 (see exhibit attached to permit request). A Temporary Change in Location of Well was granted to the Campbell County Cemetery District by the Superintendent of the State of Wyoming Water Division II on October 11, 2013. If a permanent change is requested, a Petition must be filed with the Board of Control during the period of temporary change.

Chapter 12 of the Gillette City Code requires that no well of any type or nature shall be dug or drilled, nor shall any work in preparation therefore be commenced within the boundaries of the city, unless and until the person desiring to dig or drill such well has first applied for and received a permit allowing the commencement of drilling operations.

The City Council shall grant a permit to commence drilling operation provided only in the event that it shall be satisfied with the information submitted that no hazard to the general public exists, and that no undue nuisance will be created by the applicant.

The Campbell County Cemetery District requests that drilling operations be permitted for 24 hour operation and the City Council waive the requirement of Chapter 12-2(D) of the City Code which requires a deposit of $16,500 which shall be forfeited upon violation of the Permit by the applicant.

The Campbell County Cemetery District has sent the required notification to all property owners located within five hundred (500') feet of the proposed well (copy of adjacent property owner list attached with Permit Application).

Staff recommends if the Permit Application is granted, it shall include the following stipulation:

1. That a responsible person or persons will be detailed to keep all spectators at least one hundred (100') feet away from the drilling machinery and to ensure that no children will be allowed on, in or near the equipment. Temporary fencing or a security person on site for 24 hours per day may be required during drilling and development operations, upon notice from the City Engineer.
