Public Hearing to Consider the Renewal of Retail, Restaurant, Bar & Grill, Limited, Microbrewery, and Special Malt Beverage Liquor Licenses and Permits for the Licensing Period 2014/2015.
BACKGROUND:
Each year the Council, by formal action, considers the approval of the current liquor licenses and permits. This consideration is for the licensing period of April 1, 2014 - March 31, 2015.

All applications and documents needed to complete the renewal requirements and meet State requirements, have been received. The applications and documents have been sent to the Wyoming Liquor Division and have been reviewed by the WLD. All corrections have been completed with the exception of one.

The lease agreement for Bagnavilla, LLC, d.b.a. The Coop, expires on April 30, 2014. Adolfo Bagnarello, owner, is in the process of negotiating the purchase of the building. At the time this public hearing item was put into Novus, an agreement had not been reached, and to my knowledge, there is no addendum to the current lease agreement. W.S. 12-4-103 states that a license or permit shall not be held by, issued or transferred to any person who does not own the premises in which the sales room is located or hold a written lease agreement  for which the license shall be effective...

It would be staff's recommendation to approve the Restaurant Liquor License for Bagnavilla, LLC, d.b.a. The Coop, contingent upon either the purchase of the building, or an addendum extending the lease through March 31, 2015, on or before, the expiration of the current licensing period of March 31, 2014.

If an agreement cannot be met between the property owner and Bagnavilla, LLC by  March 31, 2014 for either the purchase of the building or an addendum to the lease, then Bagnavilla, LLC would need to stop serving and remove any and all alcohol/malt beverages from the premises by midnight March 31, 2014. 

MGP, Inc. d.b.a. Las Margarita's, will not be renewing their Restaurant Liquor License. Las Margarita's has been sold and a new owner/applicant will be applying for a new Restaurant Liquor License in the near future. So that the serving of alcohol/malt beverages will not be interrupted, this request for a new Restaurant Liquor License will need to be approved no later than the March 18, 2014 Regular Meeting, with an operational date of April 1, 2014.
