An Ordinance to Amend Section 14-39 of the Gillette City Code to Include Electronic Cigarettes in the Definition of Tobacco Products Which May Not be Sold, Given or Delivered to Minors Under the Age of 18. |
BACKGROUND: |
Ordinance first reading 7/0 We have prepared an ordinance to amend 14-39 of the Gillette City Code to define electronic cigarettes and to include them in the list of tobacco products that cannot be sold to people under the age of 18. The Gillette ordinance that forbids sales of tobacco products to minors is taken from the Wyoming State Statutes beginning with section 14-3-301. Those statutes were amended in 2013 to add a definition of electronic cigarettes and then further to list electronic cigarettes within the definition of tobacco products. The ordinance that has been prepared uses the same statutory language that is now in Wyoming law to restrict electronic cigarettes and permit its enforcement in our municipal court. Since electronic cigarettes are already regulated, this ordinance will not impose any new restrictions on merchants than what they should be doing now.
