Over the past year, staff members have been meeting together to assess how well Chapter 9 of the City Code serves the needs of the contemporary City of Gillette. This chapter contains the regulations for yard waste pickup and solid waste pickup as well as the rates for both services. In addition this Chapter contains rules for private solid waste haulers and miscellaneous regulations concerning how to store and handle particular kinds of refuse. Over the years, changes have been made to this chapter to add new material including all the yard waste language and the overall organization of the chapter has suffered.
This ordinance is a recodification of Chapter 9 of the Gillette City Code, which means the entire chapter has been revised. On one hand, specific sections have been changed to clarify policy and on the other hand existing sections have been relocated to make the chapter easier to read and other housekeeping amendments have been made to bring some sections up to date. A Memorandum has been prepared which lists the most important changes that have been made in this ordinance and it is attached for review along with a copy of the ordinance.
One key change is language which makes it clear that the City will have sole authority to pick up residential solid waste, from single family to four-plexes and that private commercial haulers and the City Solid Waste Division can compete for multi family dwellings larger than four-plexes and other commercial customers. This distinction has not been clear in the past to the extent that the language of the ordinance and the actual practice are contradictory.
