Council Consideration of a Contiguous Pre-Annexation Agreement for Emergency Water Service with Marlene Fetty for Property Located at 1110 Country Club Road.
BACKGROUND:
Marlene Fetty resides on a 1.99 acre un-platted parcel of property located at 1110 Country Club Road and outside the corporate limits of the City of Gillette. The Fetty property has been served by the Shelstad water well located on the north side of Country Club Road for many years. The water service for the Fetty property was never memorialized in an Agreement with the Shelstad's.

The Shelstad property has recently been annexed into the City and the property has been sold to a Hospitality Company which has plans to limit the use of the water to irrigation purposes on their property only and commercially develop the Shelstad property. As a result of the new development, the Fetty property is currently without water according to Ms. Fetty.

Permission to negotiate a Contiguous Pre-Annexation Agreement for Emergency Water Service was granted by City Council on August 19, 2014. Ms. Fetty has submitted a signed and notarized copy of the Agreement as drafted by City Staff.
