SUBJECT:
Council Consideration for the Acceptance of Public Improvements for the Pathway Repairs 2013 Project, Installed by Simon Contractors, in the Amount of $184,775.50 (1% Project).
BACKGROUND:
The Pathway Repairs 2013 (13EN20) included the repair and a 2" asphalt overlay of 6,580 LF of 8 foot wide asphalt bike path.  ADA required ramps were installed at the intersections from Lakeway Road to Ridgecrest Drive along 4-J Road and West 4-J Road.  The original contract with Simon Contractors was from Lakeway Road to Ridgecrest Drive. The pathway from Ridgecrest Drive to Oakcrest Drive was added to the contract by change order on June 23, 2014.

The contract established 30 working days to Substantial Completion and 40 working days for Final Completion. The Notice to Proceed was issued on September 3, 2013. Due to adverse weather and multiple weather days, the project went into Winter Shut-Down on October 9, 2013. To restart the project, a Notice to Proceed was issued on May 19, 2014. On June 23, 2014, a change order was issued to add the pathway from Ridgecrest Drive to Oakcrest Drive, changing the contract to a fixed completion date of September 6, 2014. The Certificate of Final Completion was issued on September 4, 2014. 

Testing was contracted with PCA Engineering, Inc. and totaled $4,256.75.
ACTUAL COST VS. BUDGET:
The original contract with Simon Contractors was in the amount of $124,073.95. There were two (2) change orders to the contract resulting in a final contract of $184,775.50.

Change Order #1 included $28,270.60 adding repairs for 299 LF to repair the pathway where extremely wet sub-grade caused pathway failure and $38,300.00 to add the  1,670 LF of pathway from Ridgecrest Drive to Oakcrest Drive. This Change Order also changed the contract from a working day contract to a fixed completion date contract.

Change Order #2 was to modify the Contract Amount to equal the Amount Completed for a net decrease after the addition in Change Order #1 of $5,869.05 to zero out the contract.
