CASE SUMMARY:
The applicants are seeking Final Plat approval to incorporate previously vacated adjacent right-of-way property into their respective lots.
CASE BACKGROUND:
The property is located at the intersection of West 8th Street and Warren Avenue. The City received a parcel of property for the future continuation of West 8th Street in 1931. The vacated right-of-way is located between the privately owned lots.  A portion of the right-of-way is no longer needed as West 8th Street will not be continued to the west due to topographical concerns and the existing development pattern. The Final Plat equally incorporates the vacated City right-of-way into each respective parcel.   

This subdivision is for ownership purposes only and there is no new development planned or required subdivision improvements. The City will deed the land back equally to the parcels to the north and south prior to recording the Final Plat. Upon recording of the plat, the vacated land will become part of the platted lots.                             
CASE REQUIREMENTS:
1.   An updated Title Report confirming the ownership of the property shall be submitted prior to recording the Final Plat.       

2.   The City will prepare a Deed for each adjacent property owner for their portion of the vacated right-of-way. The Deeds and Ordinance vacating the right-of-way shall be recorded prior to recording the Final Plat.  

3.   The Final Plat title and dedication shall be revised to state the plat is a Resubdivision of a portion of Lots 7, 8, and 9, Block 1, Sunnyside Addition at the request of the County Clerk’s Office.      

4.   The Final Plat shall show a private Access Easement for the portion of existing driveway that crosses the lot line as determined by the owners.  

5.   The Final Plat shall address all modifications identified in the review process.      
STAFF RECOMMENDATION:
Staff recommends approval of the Final Plat for Lot 4A, Block 2, Daly Addition and a Resubdivision of a Portion of Lots 7, 8, and 9, Block 1, Sunnyside Addition, Subject to all Planning Requirements.
