CASE NUMBER AND TITLE:
14.085SFP
Final Plat - Devon Addition
APPLICANT/OWNER:
Ford Properties, LLC, Curtis J. Betcher, James L. Williamson, Sara L. Hartsaw, M.D., Revocable Trust, Donald L. Barton Revocable Trust
AGENT:
Doyle Surveying, Inc.
CASE SUMMARY:
The owners are seeking Final Plat approval for a four (4) lot subdivision for ownership purposes only.
CASE BACKGROUND:
The proposed subdivision is 31.74 acres. It is located on the north side of the intersection of Butler Spaeth Road and Garner Lake Road. Lot 1 (7.26 acres) and Lot 2 (11.58 acres) have a zoning designation of C-3, Business/Services District. Lot 3 (8.05 acres) and Lot 4 (4.85 acres) have a zoning designation of I-1, Light Industrial District. Each lot has public road frontage.

The property is vacant except for an operating oil well located on Lot 3. The proposed subdivision is surrounded by a mix of uses including industrial, residential and commercial properties. The owners want to subdivide the property in anticipation of future development.

The applicants requested that the previously approved Final Plat for the Devon Addition be removed from consideration at the December 16, 2014, City Council Meeting. That plat conformed to an approved rezoning request.

The applicants requested City Council to repeal the rezoning Ordinance No. 3845 which was approved on November 16, 2014. The approved ordinance changed the zoning from C-3, Business/Services District to I-1, Light Industrial District, for the area shown as proposed Lot 1 of the Devon Addition. The first reading to repeal Ordinance No. 3845 was approved by City Council on January 6, 2015. The third reading to repeal Ordinance No. 3845 is anticipated to be on January 20, 2015. The currently proposed lot configuration will coincide with the zoning pattern upon repeal ordinance.

CASE REQUIREMENTS:
1. The following note shall appear on the plat: "This plat is for ownership purposes only. Any future development shall meet current City of Gillette standards. The Developer is responsible for all public improvements."

2. A title report shall be submitted prior to recording the plat and the plat signatures and notary blocks shall reflect the ownerships in the report.

3. The standard statement for drainage easements shall be noted on the plat.

4. The easement along Garner Lake Road shall be 50' wide.

5. The Ford Annexation shall be recorded prior to approval of this subdivision by City Council.
