CASE SUMMARY:
The owners are requesting approval of a Zoning Map Amendment to rezone an existing platted lot from C-1, General Commercial District, to I-2, Heavy Industrial District. This will allow similar development along with the adjacent lots they own that are currently zoned I-2.
CASE BACKGROUND:
The ownership consists of five (5) platted lots southeast of the intersection of Frontage Road and Energy Street. Four (4) of the lots are currently zoned I-2 and are being used for industrial purposes. The fifth lot is zoned C-1. Anticipated additional development of the ownership requires that the fifth lot be rezoned to I-2. The C-1 zoned lot has C-1 Zoning to the south and I-2 zoning to the north and east.  The zoning across Frontage Road and Gurley is I-1, Light Industrial District.

An amendment to the Zoning Map shall not take place unless at least one (1) of two (2) criteria exists as set forth in Section 12 of the City of Gillette Zoning Ordinance:

a. The Zoning Map may be amended when there is a need to correct an obvious error. In this case there was no obvious error.
 
b. The Zoning Map may be amended to recognize changing conditions within the City. This request does recognize changing conditions in the community because the majority of the land around the lot is zoned industrial and there is a desire to expand the existing industrial land use existing on the balance of the ownership.
 
Section 12 of the City of Gillette Zoning Ordinance also provides for a minimum size land area of ten (10) acres for an I-1 District. This rezoning request complies with the minimum size requirements.

Staff recommends approval of the Rezoning Request for Lot 3, Block 3, Energy Park from C-1, General Commercial District, to I-2, Heavy Industrial District, as shown on the attached Exhibit "A" Map.
