SUBJECT:
A Public Hearing for a Zoning Map Amendment for Unplatted Land in the SE1/4 SE1/4 of Section 6 and the SW1/4 SW1/4 of Section 5, T49N, R72W, of the 6th Principal Meridian, Campbell County, Wyoming from the Current Zoning, Consisting of R-1, Single-Family Residential District, R-4, Multi-Family Residential District, and C-1, General Commercial District to R-1, Single-Family Residential District, and C-P, Planned Neighborhood Business District.
BACKGROUND:
The current zoning pattern was established based upon previous plans to develop the property. The land has remained unplatted and the original plans have changed. The proposed zoning configuration is based upon a new development pattern. A Planning Requirement will be that a Final Plat for the property be approved coincidentally with the third reading of the zoning ordinance. The property is located north and west of the intersection of Southern Drive and Wyoming State Highway 50.

The 1.66 acre proposed C-P zoning area will have Highway 50 frontage and frontage on the extension of Southern Drive to the west to be platted as a part of the development. The balance of the property is proposed to be R-1 and is 30.01 acres. The property is south of the existing Doud Ranch Addition, Phase III and is otherwise surrounded by land in the County zoned A-L, Agricultural, C-3, Business Service, and I-1, Light Industrial.

An amendment to the Zoning Map shall not take place unless at least one (1) of two (2) criteria exists as set forth in Section 12 of the City of Gillette Zoning Ordinance:

a. The Zoning Map may be amended when there is a need to correct an obvious error. In this case there was no obvious error.
 
b. The Zoning Map may be amended to recognize changing conditions within the City. This request does recognize changing conditions in the community because land in the County at this intersection is zoned I-1 and C-3. Also, with the extension and future connection of Southern Drive to the west, the intersection will carry considerable traffic.
 
Section 12 of the City of Gillette Zoning Ordinance also provides for a minimum size land area of ten (10) acres for a R-1 District and one (1) acre for a C-P District. This rezoning request complies with these minimum size requirements.
