An Ordinance Providing for the Repeal of Ordinance No. 3845, Which Amended the District Zoning Map of the City of Gillette, Wyoming for Property Generally Located at 4180 Butler Spaeth Road and Legally Described as a Portion of Lot 1A, Edwards Subdivision and Property Generally Located at 3945 Ariel Avenue and Legally Described as a Portion of Tract T, Moon Meadows Estates No. 3 Subdivision from C-3, Business Services District, to I-1, Light Industrial District, Subject to all Planning Requirements.

Mr. Curt Betcher requested that the Final Plat for the Devon Addition be removed from consideration at the December 16, 2014 City Council meeting. A rezone which he requested was dependent upon the approval of the Final Plat for the Devon Addition.

Curt Betcher then requested City Council to repeal Ordinance NO. 3845 which was approved on November 18, 2014. The approved Ordinance changed the zoning from C-3, Business/Services District to I-1, Light Industrial District, for a Portion of Lot 1A of the Edwards Subdivision and a Portion of Tract T in the Moon Meadow Estates Subdivision, No. 3.

As part of the rezone Mr. Betcher worked with neighbors to place deed restrictions on the property to restrict certain I-1 uses at the north end of the property. Devon Energy, who is proposing to purchase the property, does not desire to have the deed restrictions placed on the property. Devon would rather have two (2) lots, one (1) zoned C-3 for the office building at the north end of the property which does not allow a pipeyard, and one (1) lot zoned I-1 on the south end of the property where a pipe/storage yard is a permitted use under the Zoning Ordinance standards.

The Planning Requirements for the rezone also required the Final Plat for the Devon Addition be submitted, approved and recorded prior to the rezoning request taking effect. The removal of the Final Plat on December 16, 2014 does not satisfy the Planning Requirement for the rezone to take place. Thus, Mr. Betcher has requested City Council to repeal the rezoning Ordinance.

The repeal of Ordinance NO. 3845 will revert the zoning designation to the original C-3 Zoning District, which the neighbors were satisfied with, and which will allow Devon Energy to proceed forward with their project. The original C-3 zoning designation will coincide with a new Final Plat which is tentatively scheduled as a Planning Commission agenda item for the January 13, 2015 meeting.
