Council Consideration of a Memorandum of Understanding Between the City of Gillette and Campbell County for Agreement on Shared Road Maintenance Updated March 2015.
BACKGROUND:
The City of Gillette and Campbell County entered into a Memorandum of Understanding (MOU) for Agreement on Shared Road Maintenance in March of 2011. The approved MOU required the Exhibit A Map to be updated by February 1st of each biennium after meetings between City and County staff. The Exhibit A Map was updated in January of 2013 after the first biennial review of the MOU by City and County staff with no changes in the "road split". The only update to the Exhibit A Map were adjustments in the City Corporate Limits resulting from annexations in the two-year period.

City and County staff met again in January and February, 2015 to review the Shared Roads MOU and Exhibit A Map as required in Section 4 of the agreement. As a result of the review, it was determined that many of the projects listed in Section 6 - Future Roads and Planned Roadway Improvements have been constructed and it was necessary to update the MOU and Exhibit A Map to reflect the current transportation network and the latest City annexations.

The general agreement remains consistent, by which the County will maintain the belt roads and the City will maintain interior roads. Minor changes in Section 5, Shared Road Split include: the City will begin plowing Buckskin Drive from Constitution Drive to Northern Drive, the County will begin plowing Hannum Road from Warlow Drive north to the Jurisdictional Boundary (ownership/maintenance of these roads will not change), and Swanson Road from Southern Drive to the end of the pavement near the south Jurisdictional Boundary will be City maintained as a result of the Southern Industrial Addition Annexation.

The only other changes to the MOU are found in Section 6, Future Roads and Planned Roadway Improvements, where the section was updated to reflect the only current planned roadway which is Boxelder Road from Burma Avenue west to Overdale Drive. This planned section of roadway will be owned and maintained by the City. The Exhibit A Map was also updated to reflect the aforementioned changes, in addition to updating the City Corporate limits as a result of annexations completed within the past two year period.

Overall, staff believes the Shared Roads Agreement is beneficial for roadway maintenance and alleviates confusion and ambiguity where roadways cross Jurisdictional Boundaries. The agreement ultimately provides a highly efficient service to all citizens using the transportation network in and around Gillette.
