SUBJECT:
Council Consideration of an Amendment to the Professional Services Agreement with DOWL HKM for Bidding and Construction Phase Services for the Gillette Regional Water Supply Project - Phase I District Extensions in the Amount of $618,180.00.
BACKGROUND:
During the regular City Council meeting on September 17, 2012, the City of Gillette approved a Professional Services contract with DOWL HKM in the amount of $406,950.00.  This contract did not include either bidding phase or construction phase services.  It was the intent at the time to award a separate amendment for these services to this contract to coincide with the construction contract.  It is anticipated that a construction contract will be available for consideration at the regular City Council meeting on April 21, 2015.

Professional services provided in this amendment include bidding phase, project management, field services, as-built drawings, contract closeout, placing of fee parcel monuments for pump station and control building property, and material testing services.  

In addition to the seven water districts (Cook Road, Bennor Estates, Overbrook, Rafter D, Spring Hill Ranch, Southfork, and Antelope Valley) that will receive water through wholesale Water Service Agreements, the Antelope Valley Business Park (AVBP) will be served by a new City owned distribution system.  The AVBP will pay for the construction of this distribution system and the associated professional service fees, which are not eligible for WWDC funding or Capital Facilities Tax funding.  These professional service fees included in this amendment amount to $24,410.00 and will be paid to the City by the AVBP in accordance with a separate Water Service Agreement (approved at the regular City Council meeting on December 17, 2013).

Attached is a copy of the DOWL HKM Professional Services Amendment and Wyoming Water Development Office concurrence for Bidding and Construction Phase Services for the Gillette Regional Water Supply Project - Phase I District Extensions for your consideration.
ACTUAL COST VS. BUDGET:
Payment for all WWDC eligible costs for this project are available for reimbursement from the WWDC through our 67% grant we have with them.  Payment for the 33% match will come from the District Extensions Portion of the $20M Capital Facilities Tax.  Payment for the non-eligible items will come from the individual water districts.
