An Ordinance to Amend the Zoning Ordinance of the City of Gillette, Wyoming, to Amend Section 6. n. (10), Permitted Right-of-Way Encroachments in the C-2, Central Business District (Gillette Avenue Outdoor Serving and Sales).
BACKGROUND:

Ordinance First Reading:  6/0 (Councilman Kuntz absent)
Ordinance Second Reading:  7/0 (Approved at Special Meeting - April 14, 2015)

The City of Gillette requests a modification to the text in Section 6. n. (10) of the Zoning Ordinance to allow outdoor serving and sales on Gillette Avenue in accordance with the Gillette Avenue Urban Design Plan.

The City has coordinated efforts with the Gillette Avenue business owners and the Gillette Main Street organization to allow for the placement of signs and permit sidewalk sales within the street right-of-way. Also included in the proposed amendment is to allow the use of sidewalks for the extension of food/beverage service directly in front of businesses.

In most cases on Gillette Avenue, the sidewalk area in front of the buildings is City Right-of-Way and requires authorization by the City for its use by private property owners. To ensure safe, orderly, and consistent use of the public right-of-way, a set of Design Guidelines has been written to regulate the use.

The purpose of allowing the use of the sidewalks is to contribute to a vibrant urban culture and make Gillette Avenue a more dynamic place to walk, socialize and dine. The use is to be permitted temporarily, from April 1st to October 31st, and with requirements for layout, design elements, and physical spatial requirements. A copy of the Sidewalk Café Design Guidelines, Sidewalk Use Agreement, and proposed Ordinance are attached for reference.
