BACKGROUND: |

An ordinance has been drafted to allow the Police officers to cite individuals into City Court for possession of less than 3 ounces of marijuana or use of marijuana or of being under the influence of marijuana within the City of Gillette. Conviction will carry a maximum possible fine of $750. Conviction of a third offense will carry a jail term not to exceed 3 months. The possession, use and being under the influence of marijuana are violations of state law and these cases are currently cited into the Circuit Court for trial. The aim of this ordinance is to expedite the processing of these cases and to be able to use City resources such as probation for juvenile offenders.
