SUBJECT:
An Ordinance Providing for the Vacation of a Portion of a 20 Foot Wide General Utility Easement Located on Lot 1-B, Resubdivision of Lot 1-A and Lot 2-A, Lasting Legacy Park Subdivision, as Shown on the Exhibit "A" Map, in the City of Gillette, Wyoming, Subject to all Planning Requirements.
BACKGROUND:

The applicant is requesting approval to Vacate a portion of a 20 foot wide General Utility Easement located on Lot 1-B, Resubdivision of Lot 1-A and Lot 2-A, Lasting Legacy Park Subdivision.

The Development Plan for the lot was reviewed and approved by the Planning Commission to allow Campbell County Health to build a facility at the location. During construction, the building footprint location was slightly altered from that which was approved. As a result, the building slightly encroaches into the existing easement.

The City Electric Division has noted that the applicant shall record a 10 foot wide Electrical Easement to the City of Gillette for the building's transformer. All City Divisions and other utility companies have been notified of the vacate request and no other concerns were expressed. There are utilities located in the easement, but this vacation will not hinder the operation of the utilities.
