Council Consideration of a Resolution Approving and Authorizing the Final Plat for Moonshiner Country Estates Subdivision, to the City of Gillette, Wyoming, Subject to all Planning Requirements.
BACKGROUND:
The applicant requests approval to adjust the boundary lines for 10 lots. These 10 lots have already been platted within several different subdivisions that will make up Moonshiner Country Estates.

This subdivision is located east of Moonshiner Lane between Overdale Drive and Lakeway Road.  Lots from three different subdivisions make up Moonshiner Country Estates. These subdivisions include: Moonshiner Estates, Westover Hills Phase III, and Westover Hills Phase IV. However, the majority of  lots were originally platted as part of Moonshiner Estates.
 
Moonshiner Estates II, Phase I Subdivision created a 24.67 acre parcel designated as open space that is adjacent to the nine parcels that are proposed to adjust their boundaries.  This open space area was designated as Tract A. Originally, the owner planned to have a nonprofit agency take over Tract A. However, the owner was unable to find any nonprofit agency that is willing to do so.  Therefore, the applicant is proposing to divide up a large portion of this tract among 10 adjacent lots. The remainder of the open space Tract A will be designated as Tract A1, be zoned R-S, Suburban Residential District, and consist of  9.36 acres. The Tract is not designated as open space.

Before applying for this Resubdivision, the applicant applied for a rezoning so that all the land areas added to the lots would have zoning consistent with the existing lots.  This was done to prevent the newly adjusted lots from having two different zoning designations. A case requirement of the rezoning was that the platted configuration of the new lots align with the new zoning pattern. This requirement is met with this plat.

The newly adjusted lot lines will, in most cases, significantly increase the square footage of most of the lots.  Not all of the lots that were originally platted as part of the Moonshiner Estates will be included in this subdivison. The property being added to the lots is primarily adjacent to the rear lot lines.  A few of the  lots will also gain property that is directly behind an adjacent lot, creating an L shape configuration.  Only accessory uses will be permitted in the additional lot areas and the applicant has recorded covenants to regulate the size and location of accessory structures.

A note on the plat will also be provided which will prohibit further subdivision resulting in the creation of additional lots. Lot line adjustments which do not create additional lots will be permissible.
