An Ordinance Providing for the Vacation of a Five Foot Wide General Utility Easement Located on Lot 2G, Block 1, The Villas at Legacy Ridge Subdivision, as Shown on the Exhibit "A" Map, in the City of Gillette, Wyoming, Subject to all Planning Requirements.
BACKGROUND:

The applicants are requesting vacation of a five foot wide General Utility Easement that runs along their northern property line. This easement is located at 4314 Quarter Horse Avenue and was platted in 2010 as part of The Villas at Legacy Ridge Subdivision.  The applicants are planning to extend a portion of their driveway that is not contained within the right-of-way to construct a parking pad for their recreational vehicle.  Due to the slope of the property, a six foot high engineered retaining wall will be required before the parking pad can be completed. The existing five foot wide General Utility Easement currently prohibits the construction of a wall in this location.

The applicants have contacted the utility companies and requested permission to relocate all utilities to an adjacent 20 foot wide General Utility Easement. This easement runs along the southern portion of 4304 Quarter Horse Avenue, the lot to the north and is currently vacant. All City Divisions and other utility companies have been notified of the vacate request and have not expressed any concern over the proposed vacation and utility relocation.
