SUBJECT:
Council Consideration of a Resolution Approving and Authorizing the Final Plat for the Leon Subdivision, to the City of Gillette, Wyoming, Subject to all Planning Requirements.
BACKGROUND:
The applicant requests approval to subdivide a currently unplatted parcel that is located south of Ninth Street on South Douglas Highway. The applicant wishes to subdivide this parcel for estate planning purposes. 

This Subdivision is located in a C-1, General Commercial District and there are existing structures on all three of the proposed lots.  Lot 1 is 1.33 acres, and is accessed directly from South Douglas Highway and can also be accessed from an alley to south of Ninth Street. A commercial use  has already been established on this lot. Lot 2 is 0.52 acres and lot 3 is 0.48 acres, both lots will be accessed from a 30 foot wide Access Easement over the property located at 1001 South Douglas Highway, which is the adjacent lot to the south.

Single family homes have been constructed on lots 2 and 3. These homes are nonconforming uses, since residential dwellings are not permitted in the C-1, General Commercial District.  However, all buildings on this lot are grandfathered, since they existed prior to the City Zoning Ordinance that was adopted in 1979. According to the Campbell County Assessor's Office,  all structures that currently exist on this lot were built in 1962.  

A public sanitary sewer main runs diagonally across lots 1 and 2. The water and sewer services to these three lots are a combination of individual services and shared services. This arrangement will require private utility easements and agreements between the lots.
