Council Consideration for the Approval of a Letter Agreement for the Purchase of Right of Way for the Boxelder Road Extension from the Newton Family Farms, Limited Partnership for $63,000.00 and other Considerations.
BACKGROUND:
The City has been negotiating with Newton Family Farm L.P. to secure the right of way in which to construct Boxelder Road from Skyline to Pioneer Avenue in Westover. The land will be conveyed to the City by Warranty Deed and will include approximately 4.69 acres and is 100 foot wide. In addition there will be construction easements on both sides of the fee land. The letter agreement includes all of the additional terms of consideration beyond the price of the land. A copy of the draft Warranty Deed and a drawing of the land are included. This road will be built by WYDOT.

In addition to the payment of $63,000, this section of Boxelder will be constructed with 3 forty foot street intersections with water stubs on the north and south side and sewer stubbed on both sides of the two westerly intersections. A water service tap will be constructed on the south side to support a 1" water service when the Madison Water System is operational. Any coal waste encountered during construction will be removed.  A 1 inch water stub will be installed to service the Fairmont supply building. Existing gates will be removed and stored for use by the Newtons and new gates will be installed at the location of the new intersections. A chain link fence will be installed on both sides of the new Boxelder. The City has agreed that street access can be granted for the extension of Lee Esther Lane to Westover Road at the cost of the landowners in compliance with City design and construction regulations.
