An Ordinance Providing for the Vacation of a 10 Foot Wide Walking Easement on Lots 21 & 22, Block 3, RC Ranch Phase 1, as Shown on the Exhibit "A" Map, in the City of Gillette, Wyoming, Subject to all Planning Requirements.
BACKGROUND:
Ordinance first reading:  6/0 (Councilman Kuntz absent)
Ordinance second reading:  7/0

The applicant is seeking to vacate a 10 foot wide Walking Easement that runs north/south along the property line shared by Lots 21 & 22 in Block 3, RC Ranch Phase 1. The future home owners have stated they do not want a Walking Easement on their property.

This easement was platted in 2006 as part of the RC Ranch Phase 1 subdivision and was intended for students who attend South Campus High School. This easement has not been improved. Access to the adjacent trail to the north, which leads to South Campus High School, is currently fenced off. As such, this easement has not been utilized as intended.  

In discussions with the School District, they have indicated that they are fine with the proposed Vacation. Students will still have sufficient and safe access to South Campus High School. In addition, the Engineering Department has identified an area of open space by a drainage ditch a few blocks east of the current easement.   This lot is a much more ideal spot to place a Walking Easement for students attending South Campus High School.

I move for Approval of an Ordinance Providing for the Vacation of a 10 Foot Wide Walking Easement on Lots 21 & 22, Block 3, RC Ranch Phase 1, as shown on the Exhibit "A" Map, in the City of Gillette, Wyoming, Subject to all Planning Requirements on Third and Final Reading.
