SUBJECT:
An Ordinance to Amend the District Zoning Map of the City of Gillette, Wyoming, for Property Generally Located at 912 West Second Street, and Legally Described as Lot 1, Rockpile Museum Addition, from C-1, General Commercial District to C-O, Office and Institution District, Subject to all Planning Requirements.

The applicant is requesting approval of a Zoning Map Amendment to rezone Lot 1, Rockpile Museum Addition, from C-1, General Commercial District, to C-O, Office and Institution District.

This site is located at 912 West Second Street and has four buildings on it. These buildings make up the Rockpile Museum Complex. The County has requested that the City zone this parcel C-O, Office and Institution District. The adjacent parcel to the north is owned by the County and is currently being annexed to the City and a C-O District has been requested.  To the east is a C-O District where the Campbell County Fire Department is located. To the west and south is developed property zoned C-1, General Commercial District. This lot is 1.792 acres, which exceeds the minimum area requirement of one acre.

The applicant has stated that, the C-O, Office and Institution District, is a more suitable fit for the property than the current C-1, General Commercial Zoning District. The lot was platted more than 20 years ago. Since then, significant development and expansion has occurred in this area.  Although similar to the C-1 District, the C-O District is intended for a mixture of private and public uses. Commercial uses permitted in the C-O District are of a less intensive nature than those allowed in the C-1 District. Campbell County has plans to expand the Museum to the north. 

An amendment to the Zoning Map shall not take place unless at least one of two criteria exists, as set forth in Section 12 of the City of Gillette Zoning Ordinance:

a. The Zoning Map may be amended when there is a need to correct an obvious error.  In this case, there was no obvious error.

b. The Zoning Map may be amended to recognize changing conditions within the City. This request does recognize changing conditions within the community since the County's plan is to annex the adjacent property to the north and have it zoned C-O, Office and Institution District, for expansion of the Museum.
