SUBJECT:
An Ordinance to Amend the District Zoning Map of the City of Gillette, Wyoming, for a Portion of Tract B1, RC Ranch Phase 1, from A, Agricultural District, to C-1, General Commercial District, Subject to all Planning Requirements.
BACKGROUND:
Ordinance First Reading:  6/0 (Carsrud absent)
Ordinance Second Reading: 6/0 (Rothleutner resigned)

The applicant requests the rezoning of a portion of a platted Tract of land from A, Agricultural District, to C-1, General Commercial District.

The property is located north of Southern Drive and west of Enzi Drive. The existing platted lot has split zoning with C-1, General Commercial District, along Southern Drive and A, Agricultural District, west of Enzi Drive. This zoning pattern was created during the annexation process. Approval of this rezoning request will make the entire platted Tract B1 zoned C-1.

The applicant has applied for approval of a resubdivision of the Tract to create a 1.5 acre lot in the northeast corner for the purpose of constructing a fire station facility for the Campbell County Fire Department. The total area to be rezoned is 32.76 acres.

To the north is PUD, Planned Unit Development District, developed as apartments, and a vacant parcel of C-1, General Commercial District. Also to the north is R-4, Multi Family Residential District, developed as twin homes. To the south are vacant and developed C-1 parcels and to the east, across Enzi Drive is vacant C-O, Office and Institution District. The property to the west is zoned A-L, Agricultural, in the County.

In the C-1 District, this property would provide a significant amount of commercial land at the intersection of two major roads to service the south central part of the community. 

An amendment to the Zoning Map shall not take place unless at least one of two criteria exists, as set forth in Section 12 of the City of Gillette Zoning Ordinance:

a. The Zoning Map may be amended when there is a need to correct an obvious error.  In this case, there was no obvious error.

b. The Zoning Map may be amended to recognize changing conditions within the City. This request does recognize changing conditions within the community. Since the annexation of this property, multi-family and commercial development have occurred adjacent to the property.
