SUBJECT:
An Ordinance to Amend the District Zoning Map of the City of Gillette, Wyoming, for Property Generally Located at 4180 South Garner Lake Road and Legally Described as a Portion of Lot 2 Devon Addition, from C-3, Business/Services District to I-1, Light Industrial District, Subject to all Planning Requirements. 
BACKGROUND:
The applicant is proposing to rezone a portion of Lot 2 Devon Addition from C-3, Business/Services District to I-1, Light Industrial District.

Lot 2 of the Devon Addition is located west of Garner Lake Road and east of Butler Spaeth Road. The lot is currently vacant and has access off of Garner Lake Road.

If this lot is rezoned, to the north will be vacant C-3, Business/Services District, to the south is vacant I-1, Light Industrial District,  to the east is vacant C-3, Business/Services District, to the east is Garner Lake Road and land in the County that is zoned C-3, Business/Services District.  To the east of Garner Lake Road are 58 acres in the County that are zoned I-1, Light Industrial District. To avoid spot zoning, the Zoning Ordinance Specifies that if an area is going to be rezoned I-1, Light Industrial District, a minimum of a 5 acre area must be rezoned. The rezoned portion of Lot 2 will amount to 8.16 acres of I-1 Light Industrial District. This area is also contiguous to in excess of 20 additional acres of I-1 Zoning District.

Before this rezoning goes into effect, the portion of Lot 2 that is rezoned will be required to be replatted to form a new lot matching the new zoning configuration. This eliminates lots from having split zoning.

An amendment to the Zoning Map shall not take place unless at least one of two criteria exists, as set forth in Section 12 of the City of Gillette Zoning Ordinance:

a. The Zoning Map may be amended when there is a need to correct an obvious error. In this case, there was no obvious error.

b. The Zoning Map may be amended to recognize changing conditions within the City. This request does recognize changing conditions within the City.  Much of the surrounding land is already zoned I-1, Light Industrial, and the applicant has indicated his desire to construct a warehouse on Lot 2.

The purpose of the currently vacant C-3, Business/Services District Zoning is to create a buffer between I-1, Light Industrial District Zoning and the homes which have been constructed as part of the Moon Meadow Estates Number 3 Subdivision.  In 2012, the City of Gillette Comprehensive Plan designated the appropriate zoning for this area to be a mix of commercial and industrial. Rezoning a portion of Lot 2 to I-1, Light Industrial District is congruent with the goals and objectives of the current Comprehensive Plan.
