SUBJECT:
An Ordinance Amending Ordinance No. 3528, P.U.D. Plat of the RC Ranch Business Park I to the City of Gillette to Resubdivide Lot 6 and Tract A.
BACKGROUND:
The applicant is seeking approval of a Final Planned Unit Development Plat that would amend the previously approved Final PUD Plat for RC Ranch Business Park I.

The Final Planned Unit Development Plat for RC Ranch Business Park Phase I was previously approved by City Council. This amended Plat will take Lot 6 of the Planned Unit Development Plat for RC Ranch Business Park I and split it into three lots, creating Lots 6A, 6B, and 6C. The average size of these lots is .076 acres. All lots in this Planned Unit Development subdivision must be a minimum of 1,250 square feet. These lots meet this requirement. Lots 6A, 6B, and 6C have access off of Running W Drive.

 The  Final Planned Unit Development Plat for RC Ranch Business Park I subdivision was developed to create a mixture of commercial and offices uses consistent with the C-1, General Commercial District. The Amended Planned Unit Development Plat will not change the Ordinance or the Declaration of Protective Covenants that were recorded with the Final Planned Unit Development Plat for RC Ranch Business Park I.  However, the Ordinance and Declaration of Protective Covenants will have to be amended to include Lots 6A, 6B, and 6C. 

Although commercial retail uses are permitted in this Planned Unit Development, the current fire walls that are going to be installed on Lots 6A, 6B, and 6C are not sufficient enough to support this use.  These buildings will be utilized for offices. Commercial retail businesses can locate on these lots if the fire walls are upgraded.

Anyone wishing to build on Lots 6A, 6B or 6C must ensure that the use they are seeking is permitted in the Ordinance which will accompany this Planned Unit Development. Currently, 124 parking spaces are available on the site. When establishing any uses on the site, it is important to take the total number of parking spaces into consideration. Any use which will require more than 124 parking spaces will not be permitted.  The Parks and Beautification Board previously approved the Landscape Plan for this subdivision on September 27, 2007.
