Council Consideration of a Resolution Approving and Authorizing the Final Plat for Lots 47B, 48B, 49B & 49C Saunders Subdivision 1st Extension, A Resubdivision of Lots 47A, 48A & 49A Saunders Subdivision 1st Extension, to the City of Gillette, Wyoming, Subject to all Planning Requirements.
BACKGROUND:
The Property Owners of Lots  47A, 48A, and 49A of the Saunders Subdivision 1st Extension have all come to a mutual agreement that will allow Lot 49A to be subdivided in order to create a new lot and reconfigure Lots 47A and 48A. The new parcel will be known as Lot 49C.

Earlier this year a plat was submitted to resubdivide Lot 49A.  At that time, the necessary parties did not unanimously agree with the plat.  After a series of deliberations, a new plat has been submitted which has been unanimously agreed upon by the required parties. Without the appropriate approval, easement number 661394, recorded in Book 1202 of Photos on Page 391-392 at the Campbell County Courthouse would encumber the use of the proposed Lot 49C. It has been decided that this easement will be vacated by the necessary parties, hereby removing the restrictions the easement would have placed on Lot 49C.

The newly created parcel (Lot 49C) will have access off of Warren Avenue. Lot 49C will contain a 10 foot wide Private Access Easement, so that the back portion of Lot 47B will be more readily accessible. If the owners of Lot 47B decide to build an accessory structure that will be accessed via the Private Access Easement, it will require that the Private Access Easement be paved with an all weather surface.

The land in question is located in the R-2, Single and Two Family Residential District. Each parcel in this subdivision well exceeds the minimum lot size of 6,000 square feet that is required for a single family lot in the R-2 District. Any buildings constructed on Lot 49C must comply with the requirements of the City of Gillette Zoning Ordinance, The City of Gillette Engineering Design Standards and Construction Specifications Manual and all applicable International Building Codes.

Water and sanitary sewer service lines will need to be extended to Lot 49C. Extension of all water, sewer and other utility service lines will be the sole responsibility of the property owner. The slope of Lot 49C may also require the installation of a private wastewater lift station. If a lift station is required, it will also be the financial responsibility of the property owner to install and maintain.
