SUBJECT:
Council Consideration for the Acceptance of Public Improvements for the Gillette Softball/Baseball Complex Construction Manager at Risk (CMAR) Project, Installed by Van Ewing Construction, Inc., in the Amount of $7,668,071.45.
BACKGROUND:

The City desired to construct a Softball/Baseball Complex on property owned by the City of Gillette between East Boxelder Road and Garner Lake Road on the east side of Gillette.  The project was designed through a separate contract to build eight (8) fields, and associated infrastructure.  A Pre-Construction Services Agreement was entered into with Van Ewing Construction, Inc. to develop a Guaranteed Maximum Price (GMP) to construct as many of the eight (8) fields as possible, and remaining infrastructure for the facility within the available budget. The GMP ultimately included the construction of the western four (4) field softball/baseball complex which included amenities such as:

- four (4) 215 foot regulation size fields with synthetic turf;
- fields designed to drain high intensity storms quickly to allow games to continue;
- an infield sprinkler system to provide expedited field preparation between games, especially during tournaments;
- covered dugouts with equipment hooks and storage cubbies;
- a meeting building with a team storage room;
- 28,000 square feet of protected spectator area, bleacher seating for 400 people and plaza viewing for additional spectators;
- lighting for night games;
- restroom facilities, including two (2) ADA accessible rooms;
- a grass play area with a mist maker to cool off on hot days;
- bull pens and batting cages for practice and pregame warm-ups;
- a concession building with an umpire's room; and
- a score booth for each field with full announcing capabilities and an Assisted Listening System. 
- parking lot and entrance roads from Boxelder Road and Garner Lake Road
- addition of a turn lanes on Garner Lake Road
- landscaping within and directly around the complex and parking areas

Council approved the GMP on September 16, 2013. Construction began the following week and the fields were ready for play June 26, 2015. Completion of punch-list items associated with final inspections continued until December 22, 2015.

The project experienced delays due to inclement weather throughout the spring and summer of the 2014 construction season. Without the storm drain systems in place, the area did not shed storm water from the site. Large sections of the parking lot subgrade were required to be rebuilt three (3) times and subgrade preparation depths were increased due to the moisture. Complications with the installation of the turf-liner, which went under the synthetic turf, delayed the project in the spring of 2015 until an acceptable liner could be delivered.

The project was opened for tournament play on June 26th, 2015. The Gillette Girls Fastpitch Association used the facility for the remainder of the Summer 2015 Season and the Fall 2015 Season.

Seven (7) Change Orders were executed during this project. Work associated with the additive change orders included the addition of fire extinguishers, a key box, electrical disconnects on all buildings, modifications to metal stud walls, painting of interior exposed ceilings, an additional sewer service for a grease trap, relocating roof drains, modifications for festival power, additional parking lot subgrade preparation, installing additional drainage inlets, revising the play area drainage, installing a guard rail for the Garner Lake Road widening, and sodding areas internal to the complex in lieu of hydro-seeding.
 
The total cost of the change orders on this project amounted to $192,370.45 of which $185,800.00 were attributed to the additional subgrade work on the parking lot due to excessive moisture encountered during construction. The percentage of the change orders in relation to the original contract price was a 2.57% increase.

The CMAR contract did not have provisions for Liquidated Damages for not meeting the original schedule submitted by the CMAR.

ACTUAL COST VS. BUDGET:
The original contract amount for this CMAR project was $7,475,701.00 and the final contract amount is $7,668,071.45.

Funding for this project was allocated in the Special Projects - Park Development Account 001-10-04-419-70-47310.
