A Public Hearing for a Zoning Map Amendment for Property Generally Located at 1490 Harvest Moon Drive and Legally Described as a Portion of Lot 2A Moon Meadow Estates No. 5, a Resubdivision of Lots 1 and 2 of Moon Meadow Estates No. 5, a Resubdivision of Tract R of Moon Meadow Estates No. 3, from R-4, Multi-Family Residential District, to C-1, General Commercial District.
BACKGROUND:
This parcel of land is generally located at 1490 Harvest Moon Drive. The applicant is proposing to rezone a small strip of land adjacent to Big Boy Toy Storage from R-4, Multi Family Residential District to C-1, General Commercial District. Once rezoned, this area will be replatted as part of the common area of the Amended Big Boy Toy Storage Condominium Plat. 

The area adjacent to Big Boy Toy Storage was recently downzoned from C-1, General Commercial District to R-4, Multi Family Residential District. This was done in order to prepare for a  future residential development project. After the rezoning was completed, it was discussed by the adjacent property owners that trucks accessing Big Boy Toy Storage were actually utilizing a small portion of the neighboring lot. In order to fix this problem, FirstTier Bank made an agreement with the owners of the Big Boy Toy Storage Condominiums so the area in question could be rezoned and replatted as part of their subdivision. The amount of land being rezoned is very small and will have no effect on the surrounding area. Approximately 1,176 Square feet is being rezoned and much of the surrounding land is already C-1, General Commercial District.


An amendment to the Zoning Map shall not take place unless at least one of two criteria exists, as set forth in Section 12 of the City of Gillette Zoning Ordinance:

a. The Zoning Map may be amended when there is a need to correct an obvious error. In this case, there was no obvious error.

b. The Zoning Map may be amended to recognize changing conditions within the City. This request does recognize changing conditions within the City. Property owners accessing the Big Boy Toy Storage Subdivision have been doing so using the neighboring property. Once this area is rezoning and replat of the Big Boy Toy Storage, property is complete, the owners will access the structure from their property.
