An Ordinance Providing for the Vacation of a 50 Foot Wide General Utility Easement on Tracts P and Q, Moon Meadow Estates No. 3, A Re-Subdivision of Tract 4, Moon Meadow Estates, and Tracts K and J, Moon Meadow Estates No. 2, as Shown on the Exhibit "A" Map, in the City of Gillette Wyoming, Subject to all Planning Requirements.
BACKGROUND:

The City of Gillette is requesting to vacate a 50 foot wide General Utility Easement on Tracts P and Q, at the Moon Meadow Estates No. 3 Subdivision.

Any buildings located on Tracts P and Q would be greatly encumbered by the existing 50 foot wide General Utility Easement that runs across these lots. However, this easement is no longer needed as all utilities in this easement have been removed. In return for Firstier Bank dedicating future Right-of-Way to the City, the City agreed to vacate the 50 foot wide General Utility Easement running across Tracts P and Q. This area will eventually be replatted. In the meantime, Firstier Bank has agreed to quit claim deed the future Sinclair Right-of-Way to the City. The City must receive this deed before the Ordinance can be recorded.

This easement was created by a separate instrument in 2001,  long before the Moon Meadow Estates No.3 Subdivision was recorded at the County Clerk's Office in 2007. A utility locate has been done and no active utility lines are located within this easement.  Sanitary sewer lines were previously located within this easement. However, those sanitary sewer lines were relocated to the future Sinclair Street Right-of-Way. All City Divisions and other utility companies have been notified of this request. The notified agencies have not expressed any concern over the proposed vacation.
Natural gas is located within the 10-ft wide portion of the easement adjacent to Butler Spaeth Road; however this portion of the easement will not be vacated.

I move for Approval of an Ordinance Providing for the Vacation of a 50 Foot Wide General Utility Easement on Tracts P and Q, Moon Meadow Estates No. 3, A Re-Subdivision of Tract 4, Moon Meadow Estates, and Tracts K and J, Moon Meadow Estates No. 2, as shown on the Exhibit "A" Map, in the City of Gillette Wyoming, Subject to all Planning Requirements on Second Reading.
