SUBJECT:
An Ordinance Providing for the Vacation of Two 20 foot Wide General Utility Easements Located Within the Wyobird Annexation Plat, as Shown on the Exhibit "A" Map, in the City of Gillette, Wyoming, Subject to all Planning Requirements.
BACKGROUND:
Both of these easements were established as part of the Wyobird Annexation Plat in 1981. The first easement that is being vacated is a 20 foot wide General Utility Easement that runs across the center of the lot. The second easement that is being vacated is a 20 foot wide General Utility Easement located in the northeast corner of the lot. There are currently no plans to build anything within either easement. The applicant would simply like to vacate these easements so they no longer encumber this lot. All City Divisions and other utility companies have been notified of this request and have not expressed any concerns over the proposed vacation. A utility locate has been performed and no active utilities are located within these easements. The water line for this lot is located within an easement on the western side of the lot. Sewer and electrical lines are located within an easement on the eastern side of the property. A small portion of the sanitary sewer main is not currently located within an easement. As a condition of approval of this vacation request, the landowner must dedicate a 20 foot wide General Utility Easement to the City that will cover the existing portion of the sewer main not currently in an easement.
