An Ordinance to Amend the District Zoning Map of the City of Gillette, Wyoming, for Property Generally Located at 1490 Harvest Moon Drive and Legally Described as a Portion of Lot 2A Moon Meadow Estates No. 5, a Resubdivision of Lots 1 & 2 of Moon Meadow Estates No. 5, a Resubdivsion of Tract R of Moon Meadow Estates No. 3, from R-4, Multi-Family Residential District to C-1, General Commercial District, Subject to all Planning Requirements.
BACKGROUND:
This parcel of land is generally located at 1490 Harvest Moon Drive. The applicant is proposing to rezone a small strip of land adjacent to Big Toy Storage from R-4, Multi-Family Residential District to C-1, General Commercial District. Once rezoned, this area will be replatted as part of the common area of the Amended Big Toy Storage Condominium Plat. 

The area adjacent to Big Toy Storage was recently downzoned from C-1, General Commercial District to R-4, Multi-Family Residential District. This was done in order to prepare for a future residential development project. After the rezoning was completed, it was discussed by the adjacent property owners that trucks accessing the Big Boy Toy Storage were actually utilizing a small portion of the neighboring lot. In order to fix this problem, FirstTier Bank made an agreement with the owners of the Big Boy Toy Storage Condominiums so the area in question could be rezoned and replatted as part of their subdivision. The amount of land being rezoned is very small and will have no effect on the surrounding area. Approximately 1,176 square feet is being rezoned and much of the surrounding land is already zoned C-1, General Commercial District.

An amendment to the Zoning Map shall not take place unless at least one of two criteria exists, as set forth in Section 12 of the City of Gillette Zoning Ordinance:

a. The Zoning Map may be amended when there is a need to correct an obvious error. In this case, there was no obvious error.

b. The Zoning Map may be amended to recognize changing conditions within the City. This request does recognize changing conditions within the City. Property owners of the Big Toy Storage Condo Plat have been using the neighboring property.  The rezone and subsequent approval of the Amended Condo Plat and separate Resubdivision of Lots 1 & 2 of Moon Meadow Estates No. 5 will rectify this situtation.
