SUBJECT:
Council Consideration for the Acceptance of Public Improvements for the Gillette Softball/Baseball Complex Phase I Project, Constructed by Van Ewing Construction, Inc., in the Amount of $3,926,436.74.
BACKGROUND:
The City developed a Master Plan for what is now the Energy Capital Sports Complex. This project was designed under a separate contract to implement Phase I of the Master Plan. The project was ultimately bid in schedules allowing for flexibility in choosing the scope of the project. Those schedules were awarded in two phases: Gillette Softball/Baseball Complex Phase I and Gillette Softball/Baseball Complex Phase II. Phase II has previously been accepted by Council.

The Gillette Softball/Baseball Complex Phase I project consisted of schedules that provided for:
- grading of the entire site layout according to the Master Plan
- installation of water, sanitary sewer and storm sewer infrastructure necessary for the initial complex
- construction of a perimeter trail
- construction of a sledding hill
- installation of irrigation and trees along the west side of the complex
- reclamation of the disturbed area by replacing topsoil and seeding

Council awarded the project on December 17, 2012. Construction began in January 2013 and items relating to the utilities and grading improvements were completed in November of that year. The installation of the trees and irrigation continued until November of 2015. 

The project experienced delays due to inclement weather throughout the spring and summer 2014 construction season,  not being able to install the irrigation system during the winters of 2013-14 and 2014-15, and third party delays. Final Completion was achieved on December 29, 2015.

Eleven (11) change orders were executed during this project. The additive change orders provided Project ID Signs, re-aligned the sanitary sewer main, and provided for additional erosion control wattles to be installed. The deductive change orders removed a storm sewer bore under Garner Lake Road and incorporated a trenching method instead, removed a section of tree planting and associated irrigation, eliminated the pathway soil solidification system, and deducted the cost of the irrigation controller which the City elected to provide.

The total reduction in cost of the change orders on this project amounted to $161,389.16, or a decrease of 3.9% from the original contract price.

The contract included a provision for Liquidated Damages if the fixed completion dates were not met. The completion dates were not met and the Contractor was assessed $64,000 in liquidated damages for delays.
ACTUAL COST VS. BUDGET:
The original contract amount for this project was $4,087,825.90 and the final contract amount was $3,926,436.74.

Funding for this project was allocated in the Special Projects - Park Development Account 001-10-04-419-70-47310.
