An Ordinance to Amend the District Zoning Map for Tract C of Moon Shadow No. 2 First Filing from R-1, Single Family Residential District and R-2, Single and Two Family Residential District to C-3 Business/Services District and I-1, Light Industrial District, Subject to all Planning Requirements.

Curtis Betcher (the applicant) is proposing to rezone Tract C of Moon Shadow No. 2 First Filing from R-1, Single Family Residential District and R-2, Single and Two Family Residential District to C-3 Business/Services District and I-1, Light Industrial District.

Tract C is located southwest of the intersection of Shoshone Avenue and Butler Spaeth Road. This narrow strip of land is currently vacant.  Immediately south of Tract C, the City Council approved the Betcher Annexation plat on August 18, 2015.  The City Council also approved the applicant's request that the two parcels in this annexation be zoned C-3, Business/Services District and the I-1, Light Industrial District. Rezoning this parcel to match the rezoning configuration approved in the Betcher Annexation is consistent with recent Council action.  As currently zoned, it would be very difficult to place a home on Tract C.

To the north is Shoshone Ave and C-O, Office ad Institution District, to the west is C-1, General Commercial, to the east is Butler Spaeth Road and C-3 Businesses/Services District. Most of the surrounding parcels are vacant. Before this rezoning can be approved, the applicant will need to submit a plat that meets the proposed rezoning configuration. This prevents creating a lot with split zoning. The 2013 City of Gillette Comprehensive Plan has designated the future land use of this area as mixed use.        

An amendment to the Zoning Map shall not take place unless at least one of two criteria exists, as set forth in Section 12 of the City of Gillette Zoning Ordinance:

(1)  The Zoning Map may be amended when there is a need to correct an obvious error. In this case, there was no obvious error.

(2)  The Zoning Map may be amended to recognize changing conditions within the City. This request recognizes changing conditions within the City by acknowledging the Betcher Annexation, which occurred just adjacent to this parcel. With the size of Tract C and the surrounding zoning, residential zoning is not an appropriate designation for this parcel. Rezoning Tract C to C-3, Business/Services District and I-1, Light Industrial District provides far greater potential for this tract to develop in the future. 

The City of Gillette Zoning ordinance requires that any land being rezoned C-3, Business/Services District be a minimum of 10 acres and that land being rezoned I-1, Light Industrial District be a minimum of 5 acres. When combined with the parcels from the Betcher Annexation, the minimum size requirements are met.
