An Ordinance to Amend the Zoning Ordinance of the City of Gillette, Wyoming to Allow Commercial Recreation as a Permitted Use with the City's I-1, Light Industrial District, Subject to All Planning Requirements.
BACKGROUND:

Mr. Jerry Geer (the applicant) is requesting a Zoning Text Amendment to allow Commercial Recreation as a permitted use within the City’s I-1, Light Industrial District.

The applicant would like to develop a “Cross-Fit” gym within a vacant warehouse within the City’s I-1, Light Industrial District. The City’s Zoning Ordinance does not currently allow “Commercial Recreation” within this District. Commercial Recreation is a permitted use in the City’s C-1, General Commercial District; C-2, Central Business District; and C-3, Business/Services District.

The City has received similar requests from other businesses to add “Commercial Recreation” within the City’s I-1, Light Industrial District. With the recent downturn in the economy, there is an abundance of vacant buildings within the City’s I-1, Light Industrial District that could be re-purposed to accommodate Commercial Recreation uses. Some of these Commercial Recreation uses could potentially include:

~ Gymnastics or Dance Studio
~ Indoor Sports Training Facility
~ Cross Fit Gym or Personal Fitness Center
~ Indoor Archery Range or Indoor Shooting Range

An amendment to the Zoning Ordinance Text shall not take place unless at least one of two criteria exists as set forth in Section 12 of the City of Gillette Zoning Ordinance:

(1) The Zoning Ordinance Text may be amended when there is a need to correct an obvious error.  In this case, there was no obvious error.

(2) The Zoning Ordinance Text may be amended to recognize changing conditions within the City.  This request does indeed recognize changing conditions within the City as City Staff has observed that changing market conditions require additional building space to accommodate Commercial Recreation uses.

All building alterations, additions or new construction will require all necessary building and zoning permits in accordance with the City’s adopted building codes and zoning ordinances including, but not limited to: paved parking and paved access, landscaping, handicap accessibility and other public health and safety improvements.

Staff recommends approval of a Zoning Text Amendment to add Commercial Recreation as a Permitted Use within the City's I-1, Light Industrial District, Subject to all Planning Requirements.

The Public Hearing and First Reading of Ordinance for this proposed amendment was heard at the City Council Special Meeting held on November 29, 2016. The 3rd (final) Reading of Ordinance will be held at the City Council Special Meeting on December 13, 2016.
