A Public Hearing to Consider the Report of Building Official and Hear Any Protests or Objections Thereto Regarding the Demolition of Structure and Abatement of Property Located at 410 N. Osborne Avenue, Gillette, Wyoming 82716 and Legally Described as Lot 3, Block 2, Rainbow Addition, to the City of Gillette, Wyoming.
BACKGROUND:

The property and building improvements located at 410 N. Osborne Avenue, Gillette, Wyoming 82716 and legally described as Lot 3, Block 2, Rainbow Addition, to the City of Gillette, Wyoming sustained fire damage in multiple fires on January 11, 2015, March 28, 2015, and September 21, 2015.  As a result of the fires, the structure appeared to be unfit for habitation.  On May 3, 2016 an Administrative Search Warrant (BW No. 16-0446) was issued by Municipal Judge Dumbrill to allow the Chief Building Official to gain access to the property.

 

An inspection was completed on May 9, 2016.  On May 11, 2016, a Return of the Administrative Search Warrant was filed with the Court.  The findings of the inspection resulted in multiple violations safety, housing and/or building statutes, regulations, codes and/or ordinances applicable within the City of Gillette, Wyoming and the building was deemed manifestly unsafe for any purpose.

 

On May 17, 2016 a Notice and Order of Vacation and Repair or Abatement was served on the parties believed to have interest in the property by regular U.S. Mail and Certified Mail, and posted on the property. Upon sixty (60) days from the date of service and posting of the property for abatement/repair, no work was commenced by any of the individuals/parties thereby noticed. As such, the City of Gillette, by Order of the Chief Building Official caused the demolition of the structure and abatement of the property.

 

Demolition plans were prepared with the assistance of the City of Gillette Engineering Division. The plans were provided to the City of Gillette Purchasing Division for the issuance of Quotes in accordance with City of Gillette Purchasing Policies. The following Quotes for the demolition of the structure and abatement of the property were received by the City of Gillette:

 

S&S Builders, LLC:               $16,145.00

DRM, Inc.:                              $23,097.00

Hot Iron, Inc. :                        $23,162.00

Hladky Construction, Inc.:     $48,236.00

 

The lowest responsible quote was determined to be and awarded to S&S Builders, LLC in the amount of $16,145.00.

 

Additional costs incurred for the demolition of the structure and abatement of the property are as follows:

 

PCA Engineering Inc. (Density Testing of Excavation Backfill): $200.00

City of Gillette Utilities (Removal of Electrical Service): $32.35

City of Gillette, Development Services (Plans/Specs Preparation/Construction Observation): $677.00

City of Gillette, City Attorney’s Office (Legal Review/Document Preparation): $300.00

 

The resulting total cost of demolition, billed to the Repair and Demolition Fund is in the amount of $17,354.35.

 

The Public Hearing Notice and a Copy of the Report of Building Official was sent to all parties believed to have an interest in the property. The Public Hearing Notice was also posted on the property, and advertised in the Gillette News Record on February 17, 2017. 

 

Any person interested in or affected by the proposed charge may file a written protest or objection with the Gillette City Clerk prior to the time set forth for the Public Hearing. No other protests or objections shall be considered.
