Council Consideration for the Renewal of Retail, Restaurant, Bar & Grill, Winery, Winery Satellite, Microbrewery, Special Malt Beverage, Resort and Limited Liquor Licenses and Permits for the 2017/2018 Liquor Licensing Period.
BACKGROUND:

Each year, approximately in November, the Clerk’s office receives liquor license/permit renewal information from the Wyoming Liquor Division. This information is merged into renewal application forms and each application is reviewed by the Clerk. As a courtesy to the applicant, additional information such as names, lease information, hours operation, etc., are inserted by the Clerk using the previous year’s renewal information. Each applicant is instructed to review their application to ensure accuracy and make corrections if applicable. This year 55 renewal license/permit applications were received in the Clerk’s office for the 2017/2018 liquor licensing period. They are as follows: 29 retail liquor licenses, 12 restaurant liquor licenses, 4 bar & grill liquor licenses,  2 resort liquor licenses, 5 limited club liquor licenses, 1 winery permit, 1 winery satellite permit, 1 special malt beverage permit, and 1 microbrewery permit.

 

All renewal applications are then reviewed one last time to ensure each application is complete, signatures notarized, as well as all necessary supporting documents attached. These applications are then sent to the Wyoming Liquor Division for their review and approval. If corrections are necessary, the WLD will notify the Clerk’s office. The applicant is then notified regarding the correction(s). The corrections are sent back to the WLD for their final approval prior to the public hearing and Council’s consideration.

 

The Clerk’s office was notified by Buddy Cater, Knights of Columbus, that the Knights of Columbus does not intend to renew the Club's liquor license. As of March 31, 2017, they will be required to remove all alcohol and malt beverages, and cease from dispensing/serving alcohol and malt beverages on the premises.

 

On October 13, 2016 an email was received from Trevor Schilling on behalf of Town Center 2, LLC (TC2) as landlord for Sweetwater Gap, LLC d/b/a Jordan’s Fine Dining.  The purpose of the email was twofold.  First, the email asserted that Sweetwater Gap, LLC was in default in the terms of its lease, and was no longer a tenant of Town Center 2, LLC (TC2), at 2721 S. Douglas Hwy.  Secondly, the email stated that a new lease was in place with Wyoming Rib & Chop as a new tenant at that location.  The application for Wyoming Rib & Chop, along with Mr. Schilling’s email, were submitted to the Wyoming Liquor Division for processing of its new bar and grill license.  The State did not object to the new bar and grill license being assigned to 2721 S. Douglas Hwy., the location formerly of Sweetwater Gap, LLC.  Wyoming Statute 12-4-103 requires an entity holding a liquor license either own the building where operations will be conducted, or have a valid lease for that time in which the liquor license is valid.  Additionally, Wyoming law does not allow a retail liquor license and a bar and grill license to occupy the same address and/or structure.  As the license held by Sweetwater Gap, LLC was not transferred to another location, did not possess a valid lease for any premises, and could not have shared the premises with the Wyoming Rib & Chop license, a renewal was not sent to Sweetwater Gap, LLC. 

 

Eischeid Investments, LLC, changed the d.b.a. name of their establishment from The Chophouse to Rail Yard.  IBLA, LLC, changed the d.b.a. name of their establishment from I Siciliani Italian Restaurant to Armando's Taco and Pasta Shop.

 

The public hearing notice was advertised on February 3rd and February 10th. As of February 10th no protests have been received. All applicable corrections have been made and the Wyoming Liquor Division has accepted the renewal applications for the liquor licensing period of 2017/2018.
