Council Consideration for the Acceptance of Public Improvements for the Gillette Regional Water Supply Project Phase I District Extensions, Installed by Redpoint Contracting, in the Amount of $6,156,852.38. 
BACKGROUND:
This project is the first phase of a series of projects to provide water to water districts as part of the Gillette Regional Water Supply project.  This project extended water to Cook Road, Bennor Estates, Overbrook, Rafter D, Spring Hill Ranch, Southfork, and Antelope Valley.  To facilitate these connections, this project consisted of the installation of approximately 54,000 lineal feet of 12" and 8" PVC water main, two pump stations, and seven control buildings.  
 
The Antelope Valley connection was made by connecting to the new pipeline at the corner of Patty Ave. and Schoonover Rd. and running a new 12" PVC pipeline to the Antelope Valley water tank.  Spring Hill Ranch is connected to the City of Gillette Distribution system in Hidden Valley Rd. with a new 8" PVC pipeline that will connect to their distribution system near their well site.  The remaining five water districts are connected to a 12" PVC pipeline that begins at the Z1R5 tank in the Doud Ranch Subdivision.  This pipeline was installed in Rock Rd., Brahma St., Roany Rd., and along Force Rd.  Connections to this pipeline for each water district are made with 8" PVC pipelines.  All seven water district connections include a control building that houses a water meter, backflow preventer, supervisory control and data acquisition (SCADA) equipment, and all other necessary valves, piping, and equipment to provide water to these districts.

 

Three separate payment bond claims were filed by subcontractors in the course of closing out the project.  As such, a consent of surety, affidavit on behalf of contractor, lien waivers (conditional and unconditional) are provided.  To the best of the knowledge of staff, one claim has been resolved, and two have outstanding disagreements and are being handled by legal proceedings between the parties.

 

The contractor is providing an additional 2 year warranty for the Antelope Valley Pump Station Yaskawa Variable Frequency Drives (VFDs), 50 horsepower Baldor Motors, and CR-120 Grunfos Pumps due to a failed pump test at the specified conditions.  In order to achieve the specified flow and pressure, the motors have to be run at 62 hertz rather than the specified 60 hz.  Each manufacturer has provided written assurance that their equipment can safely operate at these conditions without affecting the service life.  Additionally, the contractor paid for the Engineer's time in responding to this failed test through a pay item deduction in the amount of $2,240.00.

ACTUAL COST VS. BUDGET:

The budget for this project was $9,600,000.00, which includes engineering, land acquisition, and construction phase inspection services.  The Engineer's estimate for construction at the time of bidding was $7,045,260.00 and the following bids amounts were received.

The original contract amount for this project was $5,580,150.00.  There were eleven change orders for a net added cost to the project of $576,702.38 (10.3% increase).  Below is a summary of these change orders:

Substantial completion contract time was overrun by 29 days, resulting in $52,200.00 in liquidated damages for substantial completion charged to the contractor. Additionally, final completion contract time was overrun by 49 days, resulting in $63,700.00 in liquidated damages charged for final completion.  In total, $115,900.00 in liquidated damages was deducted from contractor payments.
