Council Consideration of a Resolution Directing Staff to Mail Annexation Petitions to Landowners Within Crestview, Antelope Valley, Antelope Valley Business Park and Surrounding Area.
BACKGROUND:

During the City Council Retreat in January, the City's Strategic Annexation Plan was considered.  As part of this Plan, the area including Crestview, Antelope Valley, Antelope Valley Business Park and adjacent areas was considered for annexation purposes.

Most of the Landowners within the Antelope Valley and Antelope Valley Business Park Subdivisions have previously executed Annexation Petitions as part of their individual Annexation Agreement in exchange for receiving City services like sanitary sewer or water.  Other Landowners - mainly in the Crestview Subdivision and other adjacent areas - have not executed prior Petitions or Annexation Agreements.

Per Wyoming State Statutes, no signature on the petition is valid if it is dated more than 180 days prior to the date of filing the petition with the City clerk.  No person signing a petition for annexation may withdraw his signature from the petition after it has been filed with the clerk.

Within 10 days from the date the petition is filed, the City clerk shall determine if the petition substantially complies with Title 15, Chapter 1, Article 4 of the Wyoming Statutes regarding annexation. If the petition complies, the City clerk shall certify compliance and the following procedure(s) within the Wyoming Statutes shall be followed.

The Governing Body shall establish a date, time and place for a Public Hearing to determine if the proposed annexation complies with Wyoming State 15-1-402.  The Public Hearing shall be held not less than 30 days, nor more than 180 days after the petition has been certified by the City Clerk to be complete.

If Annexation Petitions are mailed to all Landowners on, or around, Monday, April 3, 2017, the City Clerk will need to certify all petitions by Friday, September 29, 2017 in order to meet the 180 day requirement.  Likewise, the Resolution to Establish a Public Hearing will be considered during the October 3, 2017 City Council Meeting.  The Public Hearing will be scheduled during a separate City Council Meeting - probably during the November 7, 2017 Council Meeting.  When considering three separate readings of the Annexation Ordinance, and other publication requirements, the proposed annexation area could potentially be annexed by the end of 2017, or early 2018.

ACTUAL COST VS. BUDGET:
Costs associated with postage to deliver the annexation petitions via certified mail will come from the City's General Fund.

I move to approve a Resolution directing Staff to mail Annexation Petitions to Landowners within Crestview, Antelope Valley, Antelope Valley Business Park and Surrounding Area.
