CASE SUMMARY:

The owner is requesting the construction of a new eighty-two (82) unit, four (4) story Hampton Inn & Suites to be located on Lots 2A and 2B, Block 1, of Westover Hills Subdivision Phase 1 more simply known as 2300 & 2312 Westover Road. 

CASE BACKGROUND:

The vacant 3.69-acre property legally described as Lots 2A and 2B, Block 1 of the Westover Hills Subdivision Phase 1 was originally platted as Lot 2 of the Westover Hills Subdivision Phase 1 in 1980. In 1988 the original Lot 2 was split into Lot 2A and Lot 2B. No development has ever taken place on either of the two lots. Both lots are currently zoned C-1, General Commercial and are entirely surrounded by C-1 zoning with the exception of I-90 to the north which is zoned as 1-2, Heavy Industrial. This proposal is compatible with the Land Use Plan as the Land Use Plan envisions this area to develop as General Commercial.

The four (4) story hotel is proposed to be constructed entirely on Lot 2A while Lot 2B will be utilized for access to the hotel, parking, and landscaping. However, there will be parking and landscaping on Lot 2A as well. Regarding parking and access, eighty-two (82) spaces are required and eighty-two (82) spaces have been provided including adequate handicap parking. A Cross Parking and Access Agreement is required for this project because parking for the hotel exists on both Lot 2A and Lot 2B. Due to the height of the building and architectural features, the Fire Department is requiring that the outer-east driving lane be a required fire lane and therefore marked as such. Landscaping is adequate for the site as twenty-five (25) trees and sixty-eight (68) shrubs are required and forty-one (41) trees and three hundred seventy-three (373) shrubs and perennials will be provided. The Parks and Beautification Board approved the landscape plan during their meeting on April 13, 2017.

Per Section 11 of the City’s Zoning Ordinance, approval of the Development Plan by the Planning Commission shall be effective for thirty six (36) consecutive months from the date of approval. The Planning Commission may, upon written application by the developer and for cause shown, grant up to two (2) extensions of approval, not to exceed twelve (12) months each. 

CASE REQUIREMENTS:
  1. The applicant and agent shall address all comments and concerns within ePlans before the Development Plan can be recorded with the County Clerk.
  2. The agent shall prepare and the applicant shall sign and have their signature notarized on the final Development Plan which shall incorporate all comments in Planning Requirement No. 1.
  3. The final, signed, original mylar copy of the Development Plan shall be submitted to the City Planning Division. City Staff shall route the Final Plan for final signatures and shall record with the County Clerk. The applicant shall be responsible for the County recording fees.
  4. The approved landscape Plan shall be installed and maintained in accordance with Section 14 of the City’s Zoning Ordinance.
  5. Signage, fencing, and retaining walls shall be permitted separately through the Building Inspection Division, prior to installation.
  6. A Cross Parking & Access Agreement will be recorded with the County Clerk.  The recorded copy will be provided to the City of Gillette Planning Division before a final Certificate of Occupancy will be issued.
  7. The applicant shall apply for the appropriate water, wastewater, and storm drainage permits through the City Engineering Division.  These permits are necessary prior to issuance of the final Building Permits.
  8. The applicant shall work with the City Electrical Division to obtain any necessary easements prior to the Certificate of Occupancy being issued. All requirements of the Electrical Division shall be met.
  9. Once the Development Plan has been recorded with the County Clerk, the final zoning permit shall be issued and shall accompany the necessary Building Permits.
STAFF RECOMMENDATION:
Staff recommends approval of this Development Plan, Subject to all Planning Requirements.
