Council Consideration of a Memorandum of Understanding Regarding Ownership in Phase I and Phase II of the Gillette College Student Housing.
BACKGROUND:

The City of Gillette and the Northern Wyoming Community College District/Gillette College entered into previous agreements to construct Student Housing Facilities. The first project included four (4) buildings and the second project included a three (3) story residential building and kitchen/dining hall facility.

This Memorandum of Understanding (MOU) serves to identify how the projects will be split up for ownership purposes based upon the 83% (City) and 17% (College) funding formula used to construct the projects. The Phase I project will be divided using a Planned Unit Development (PUD) platting/zoning process and the Phase II project will utilize a Condominium Plat process. 

The Phase I property division will transfer ownership of Lot 4 (Building 3) to the College and the City will retain ownership of Lots 1, 2, and 3 (Buildings 1A, 1B, and 2). The City and the College will each have an ownership interest in the common areas/spaces as identified in the PUD Ordinance.

The Phase II property division will transfer the dining hall/kitchen portion of the structure to the College and the City will retain ownership of the balance of the structure (3 story residential area and corresponding administrative/office space). The Condominium Plat will identify the unit areas upon its formation.

This MOU does not change any additional terms of the prior agreements for the Phase I and Phase II Student Housing Projects.

The proposed MOU, as executed by the Northern Wyoming Community College District/Gillette College, is attached for reference.
