Council Consideration of a Resolution Initiating Annexation of a Tract of Land Contiguous to the City of Gillette, Wyoming, Pursuant to W.S. 15-1-402, 15-1-403 and 15-1-405, Generally Known as the Antelope Valley and Crestview Estates Addition Annexation, and Establishing a Public Hearing Date of November 7, 2017 for the Annexation Public Hearing.
BACKGROUND:

On March 30th, 2017, landowners petitioned the City of Gillette for the annexation of a tract of land adjacent and contiguous to the City of Gillette, Wyoming, pursuant to Wyoming Statute 15-1-403.  Upon receipt of additional Annexation Petitions and in consideration of all executed Annexation Agreements and Petitions, these documents have effectively initiated the annexation process for a 742.48 acre tract of land in the proposed annexation area generally known as the Antelope Valley and Crestview Estates Addition Annexation.  This area is a logical extension of the Gillette City limits and will be serviceable by public utilities and services.

On September 20th, 2017, the Annexation Petitions were filed with the Gillette City Clerk along with the Application for Annexation, and subsequently the corresponding Annexation Plat.  On September 21st, 2017, pursuant to Wyoming Statute 15-1-403, the Gillette City Clerk certified the Annexation Petitions for compliance with 15-1-Article 4.  

The proposed zoning of the area is C-P, Planned Neighborhood Business District, A, Agricultural District, C-1, General Commercial District, I-1, Light Industrial district, R-1, Single Family Residential, R-2 Single & Two Family Residential, R-4, Multiple-Family Residential, and R-R, Rural Residential. The proposed zoning meets the intent of the Comprehensive Plan. The existing development pattern is compatible with the proposed zoning. The City Council will make the final zoning determination at the time of annexation.

As per agreements established with the City of Gillette, costs for upgrades to infrastructure on Gallery View Drive will be incurred by the City at a time when a project is coordinated and funding is available.  Otherwise, there is no significant City investment required in support of this annexation for water, sewer, streets, drainage or parks. 

Landowners within the proposed annexation area will be responsible for all costs associated with the extension of water, sewer, streets, drainage and other infrastructure improvements required at the time of any future development.  Such development shall also be in accordance with City Zoning and Subdivision Regulations and City Engineering Design Standards and Construction Specifications.  The annexation area is currently served by a combination of City and various local service district services.  Any future development or construction will be reviewed by the City and shall meet City Standards.

Public Hearing notices and Annexation Reports will be sent via certified mail in accordance with Wyoming Statute 15-1-405 and 15-1-402, respectively, to all affected landowners and utility companies within the annexation area and within one-half (1/2) mile of the newly proposed corporate limits of the City.  The public hearing notice will also be published in the Gillette News Record on October, 6th, 13th, and 20th, 2017.

City Staff recommends approval of the attached Resolution to Initiate Annexation and Establish the Annexation Public Hearing Date as November 7th, 2017.

ACTUAL COST VS. BUDGET:

The City has budgeted $30,900 within the Development Services (Planning Division) operating budget for the development of the Annexation Plat.  This work has been performed by PCA Engineering.
