A Public Hearing to Consider the Transfer of Ownership of Retail Liquor License RTL-25 from R&L, Inc., to DLM Investments, LLC, d.b.a. Energy Station, and Transfer of Location of Said Retail Liquor License RTL-25 from 309 W Lakeway Road to 302 W Lakeway Road, Suite 110.
BACKGROUND:

DLM Investments, LLC, is requesting the transfer of a retail liquor license, as well as the location of the liquor license, currently held by R&L, Inc. (Beverage Broker).

 

The applicant is in the process of constructing a new building at 302 W Lakeway Rd that will house the liquor license, if transferred. According to the diagram, liquor sales/dispensing will be located at the east end of the building. Due to the recent changes in liquor laws, dispensing rooms are no longer used to describe the area in which liquor can be sold/dispensed. It is now known as the "licensed building". Since the liquor store will be in the same building as a convenience store and Godfather's Pizza, the applicant was required to obtain a suite number to delineate the liquor store area from the rest of the building. Thus allowing minors to be in the convenience store and Godfather's Pizza without violating state and/or city laws.

 

 

The applicant has requested the postponement for the transfer, twice, due to delays with the building project. The transfer was first scheduled on September 19th and re-scheduled for October 3rd. At the request of the applicant, the transfer was again postponed from October 3rd to October 17th. On October 4th, staff had a meeting with Bob Downey, (R&L, Inc. and current holder of the liquor license) to discuss the "punch list" that would need to be taken care of before a CO, or even a TCO, could be issued. And, according to Fire Marshall Acton via an email, he could not support a TCO for about a month. In Mr. Acton's email, dated October 3, 2017, he stated: "Since fire alarm plans haven't even been submitted yet and I would need 1-2 week review time allowance, add installation time and testing afterward, I wouldn't be able to support a TCO until about a month from now." Interim Director VonEye brought a few other "punch list" items to Mr. Downey's attention as well. It was explained to Mr. Downey that once the liquor license has been transferred, R&L, Inc., could not buy/sell/dispense any alcohol/malt beverages at 309 W Lakeway Rd, nor could DLM Investments, LLC,  buy/sell/dispense any alcohol/malt beverages at 302 W Lakeway Rd., Ste 110 until, at least, a TCO was issued. Mr. Downey stated that he would discuss this with his partners. Later that same day, Mr. Downey called and spoke with Deputy Clerk Staskiewicz and told her that DLM Investments, LLC, wants to move forward with the transfer of ownership and location of the retail liquor license during the October 17, 2017 meeting. The public hearing notice was re-scheduled with the News Record and the establishment was re-posted to reflect this request. 

 

All necessary paperwork for the transfer has been received and sent to the Wyoming Liquor Division for their review and all corrections have been made.
